Mr. Loza was deceptive from the beginning.

Q. Would it surprise you to know that the rock hit the windshield on the driver’s side?

A. Would it surprise me? I am not surprised, no.

Q. Were you holding your son when you threw the rock?

A. Yeah.

Mr. Loza threw a rock at Ms. Barstow through the windshield while she was trying to escape. She was sitting in the driver’s seat. He also bashed the window on the driver’s side. He did this while clutching Sterling, crying, in his other arm.

“The father stated that the mother has a bruise on her calf.  He stated that is not due to him hitting her. The father stated that a toy hit heron the leg.”

Mr. Loza threw a toy at Ms. Barstow’s leg. He claimed it was an accident. This photo was taken about ten days later. Mr. Loza was arrested for this one.

Judge Kennedy found Mr. Loza 'not guilty' because he argued he had 'no intent' to inflict harm.
